Overview
When a taxpayer receives a negative audit result or refund claim denial that cannot be resolved with the Comptroller’s audit division, the taxpayer has the option to request an administrative appeal. An administrative appeal involves exchanging briefing with an attorney representing the Comptroller and ultimately, if the case cannot be resolved, an oral or written submission hearing before the State Office of Administrative Hearings. We have handled literally thousands of administrative appeals and hundreds of SOAH hearings. We have a remarkable record of success in these hearings based on understanding which types of cases should go to a hearing and applying the specific approach necessary to obtain a favorable outcome.
