Representing Google LLC as lead counsel, SDM wholly defeated a petition filed in Texas state court by a Taiwanese tech company to take a deposition to investigate potential claims of fraud arising out of prior patent proceedings before the United States Patent Office’s Patent Trial and Appeal Board. The Taiwanese tech company then filed suit in the United States District Court for the Western District of Texas, Waco Division alleging fraud. SDM, along with co-counsel from O’Melveny & Meyers, filed a Motion to Dismiss the suit against Google. District Judge Alan Albright dismissed the suit in February 2021 for lack of personal jurisdiction.

The Texas state court proceeding was In re CyWee Group Ltd., Case No. C-1-CV-19-009205, County Court at Law No. 2, Travis County, Texas.
