City of San Antonio – Sanctuary City
SDM represents the City of San Antonio, the City Manager, and the City's Chief of Police in Texas Attorney General Ken Paxton’s first enforcement action under controversial Senate Bill 4—the so-called “anti-sanctuary city bill” that took effect on September 1, 2017. In this matter, Paxton is seeking daily penalties of $25,500 for alleged violations of Senate Bill 4. In July 2019, the court granted the City’s partial motion for summary judgement, seeking dismissal of claims based on statutory provisions that were enjoined from enforcement when alleged violations occurred. In the intervening period since the partial dismissal of claims, extensive discovery has occurred in this matter. The City has asserted several defenses, including constitutional defenses, against Paxton’s claims. The case is set to go to a jury trial in September 2021.
