Carroll Martin and Jane Webre Win Bench Trial Over Disputed Mineral Interest

Carroll Martin and Jane Webre won a judgment declaring that their clients’ beneficiaries own a disputed undivided mineral interest in three sections of land within a producing gas field. After a bench trial, the court declared that the firm’s clients—and not the plaintiffs—own the disputed interest on the basis of the original conveyance in the 1930s and a stipulation of interest/settlement agreement made in the 1990s. The clients’ beneficiaries are members of a family that has owned the subject property in Duval County for three generations. Hon. Ana Lisa Garza rendered final judgment for the firm’s clients, including attorneys’ fees and costs, in September 2011.
