Paige Amstutz and Dan Bitting to Speak at the 17th Annual Texas Aggie Bar Association Annual Conference

Paige Amstutz and Dan Bitting will be featured speakers at the upcoming 17th Annual Texas Aggie Bar Association Annual Conference on March 4-5 in College Station. Dan Bitting will moderate a panel of state court judges on the topic: "Everything You Wanted to Know About State Court But Were Afraid to Ask." Paige Amstutz will speak on state bar advertising rules: "State Bar Advertising Rules - Can You Say That?" Casey Dobson and Paige Amstutz Win Jury Trial
05/15/2015

Representing one of the largest law firms in San Antonio, SDM attorneys Casey Dobson and Paige Amstutz prevailed after more than a week-long jury trial in a breach-of-fiduciary-duty case. Plaintiff, a former client of the San Antonio firm, sued alleging legal malpractice and breach of fiduciary duty and sought damages in excess of $40 million. After Mr. Dobson and Ms. Amstutz won summary judgment defeating plaintiff’s legal malpractice claims and establishing the client had suffered no damages, the jury trial proceeded solely on the issue of whether defendants breached their fiduciary duties. In its verdict delivered on May 11, 2015, the jury unanimously found in favor of SDM’s client. The court then entered a final judgment that the plaintiff take nothing and imposed costs on the plaintiff. To date, plaintiff has not appealed the judgment.

SDM Lawyers Win Order Enjoining Judgment Debtor from Dissipating or Transferring Assets
04/08/2015

After winning a final judgment in an amount in excess of $10 million against defendants Lakeway Regional Medical Center and Surgical Development Partners, SDM lawyers Abe Kuczaj, Paige Amstutz, and Steve Wingard filed an application for an injunction to preclude one of the defendants from dissipating or transferring assets to avoid satisfaction of the judgment pending appeal of the final judgment. Finding that SDM presented evidence establishing that the defendant was likely to dissipate or transfer assets in the future to avoid satisfaction of the judgment, the Court entered an injunction in favor of SDM’s client.

Legal Team including SD&M Lawyers Win Dismissal of Patent Infringement Case
03/31/2015

SDM attorneys Steve McConnico, Paige Amstutz, and Steve Wingard, along with lead counsel from Latham & Watkins, won dismissal of a patent infringement lawsuit when their Motion to Disqualify opposing counsel was granted.  SDM represented a large, publicly-traded energy company in defense of claims brought by a publicly-traded non-practicing entity.  SDM filed a motion to disqualify plaintiff’s in-house general counsel, plaintiff’s entire legal department, and plaintiff’s outside counsel. In addition, SDM requested that the court dismiss the lawsuit. The court granted SDM’s motion, disqualified all plaintiff’s counsel, and dismissed the lawsuit.

SD&M Lawyers Win Summary Judgment in Premises Liability Case
02/13/2015

SD&M Lawyers Paige Amstutz, Sara Clark, and Robyn Hargrove obtained a final summary judgment in favor of a national hotel chain client. The case arose from an arrest on the hotel premises of an individual who claimed that the hotel’s conduct wrongfully contributed to his arrest. The trial court disagreed, and granted final summary judgment for the defendant on all claims.
