Jane Webre and Kennon Wooten Accept Nominations for ALI Membership

Jane WebreKennon WootenSD&M attorneys Jane Webre and Kennon Wooten have accepted their nominations for elected membership in the American Law Institute.  When reviewing candidates for membership, the Institute’s Membership Committee considers the following characteristics: professional excellence; experience, interest, and involvement in activities that fall within the mission of the Institute; anticipated desire and commitment to participate in, as well as to make potential contributions to, the Institute’s work and law reform activities; achievement or promise of future achievement in the candidate’s chosen endeavor in the law; and professional recognition or standing among peers.  The Institute—made up of judges, lawyers, and law professors—drafts, discusses, revises, and publishes Restatements of the Law, model statutes, and principles of law that are influential in the courts and legislatures, as well as in legal scholarship and education.

Casey Dobson, Jane Webre and Mike Merriman Prevail at 5th Circuit

SDM’s Casey Dobson, Jane Webre and Mike Merriman successfully defended the Central Texas Regional Mobility Authority (CTRMA) against an emergency motion for injunction pending appeal brought by a group of plaintiffs attempting to stop construction on State Highway 45 Southwest.  After the district court denied plaintiffs’ application for preliminary injunction in October 2016, the plaintiffs appealed and filed the emergency injunction motion with the Fifth Circuit.  The Fifth Circuit heard oral argument in Austin on the injunction application on November 4, then denied the motion just hours after argument.  The order allowed CTRMA to start construction on State Highway 45 Southwest immediately.  For more details on this dispute, see SDM’s October 24, 2016 news release.

The appeal is Fath, et al., v. Texas Department of Transportation and Central Texas Regional Mobility Authority, No. 16-51281 (5th Cir.).

SDM's Casey Dobson, Jane Webre and Mike Merriman prevail in Texas 45 Injunction Hearing
10/24/2016

SDM’s Casey Dobson, Jane Webre and Mike Merriman successfully defended the Central Texas Regional Mobility Authority (CTRMA) against an application for preliminary injunction brought by a group of plaintiffs attempting to stop construction projects on State Highway 45 Southwest and MoPac South.  Following an all-day injunction hearing in the Western District of Texas, the Court found that plaintiffs did not meet their burden to establish a substantial likelihood of success on the merits of their claims against CTRMA and the Texas Department of Transportation under the National Environmental Policy Act (NEPA).

The case is Fath, et al., v. Texas Department of Transportation and Central Texas Regional Mobility Authority, No. 16cv00234-LY (W.D. Tex).

UT Law 26th Annual Conference on State and Federal Appeals Features Jane Webre and Kennon Wooten
04/26/2016

SDM’s Jane Webre and Kennon Wooten will be featured speakers at the upcoming 26th Annual Conference on State and Federal Appeals on June 9-10 in Austin. Jane will discuss attorney disqualification, including rules regarding migrating lawyers and former judicial law clerks and the role regarding Chinese Walls to screen conflicts and avoid disqualification of a firm. Kennon will address dismissal procedures under Texas Rule of Civil Procedure 91a, including how Texas courts have handled cases involving Rule 91a and the extent to which federal dismissal standards have crept into Texas jurisprudence. The State Bar Litigation Section’s Fall 2015 Report “The Advocate” Features Article by Jane Webre

The Fall 2015 edition of The Advocate, a quarterly State Bar of Texas Litigation Section publication, features an article by SDM’s Jane Webre. The edition as a whole includes a symposium on Texas state court motion practice, and Jane Webre’s article addresses whether an interlocutory appeal or mandamus relief may be available from a trial court’s ruling on the various motions discussed by the other contributing authors in the symposium.

SDM Wins Appeal Affirming Summary Judgment Rulings in Well Blowout Coverage Dispute
09/15/2015

SDM lawyers Jane Webre, Steve Wingard, and Robyn Hargrove prevailed in an appeal of summary judgment orders. SDM represented the operator of a well in Reeves County, Texas. After the well suffered  a blowout, the insured paid to bring the well under control, to attempt to restore production at the well, and to address pollution cleanup. The insured filed claims with its insurance carriers under well-control and commercial-general-liability policies, but the carriers denied coverage. SDM won summary judgments at the Midland County District Court, which ruled that the well was a “well-insured” under the policies and that the insured incurred damages in excess of the policies’ limits. The insurance companies appealed to the Eastland Court of Appeals. Finding no error, the Eastland Court of Appeals affirmed the trial court’s summary judgment rulings and taxed all costs against the insurance companies.

Each year, SDM attorneys dedicate significant time serving in a variety of legal leadership roles. This year, these SDM attorneys will serve on the following diverse local and state-wide boards and committees:

Anthony Arguijo is the President-Elect of the Hispanic Bar Association of Austin and serves as the Association’s representative to the Austin Young Lawyers Association.  
 
Dan Bitting serves on the Board of the Texas Aggie Bar Association.

Sara Clark serves on the Board of the Litigation Section of the Austin Bar Association, the Board of Volunteer Legal Services of Central Texas, and the Downtown Austin Community Court Advisory Committee.
 
Cindy Saiter serves on the Board of the Austin Bar Association and is Co-Chair of its Membership Committee. She also serves on the Nominating Committee for District 9 of the Texas Bar Foundation, the State Bar Committee on Women in the Profession, and the Board of the Travis County Women Lawyers Scholarship Fund, and is Chair of the Travis County Women Lawyers’ Foundation.
